General Terms and Conditions of Sale

  1. General Provisions

These general conditions of sale (hereinafter,” General Conditions”) govern all sales of products (hereinafter, “Products” or “Product”) concluded at a distance on the website www.toniatointeriors.com (hereinafter, the “Site”).

  1. Seller identification

The seller is Art Casa s.r.l., of which the brand Toniato Interiors is part, having its registered office in Via Guido Rossa 7, 35020 Ponte San Nicolò (PD) Italy, VAT no. 01338880287, tax code no. 01338880287, REA PD – 205090.

  1. Information regarding products and their availability

Information about the Products, together with the Product codes and their prices, is available on the Site.
Art Casa srl reserves the right to limit, at any time, the quantity and/or type of Products that can be purchased on the Site. The style, models and colors of the Products described on the Site may be changed without notice. During the purchase process, if it is not possible to process the order due to the unavailability of the ordered Product, the Customer will be notified by e-mail.
Art Casa srl is in no case responsible for any errors resulting from the failure of the Customer’s connection to the Site.

  1. Price

The price of the Products indicated on the Site is expressed in Euro and does not include any taxes and delivery charges.
Art Casa srl constantly verifies the accuracy of the prices indicated on the Site; however, it is not possible to guarantee the absence of errors. In the event that an error is found in the indication of the price of a Product, Art Casa srl will reject the order and offer the Customer the opportunity to purchase the Product at the correct price. If the error is found only after the acceptance of the order, Art Casa srl will offer the Customer the opportunity to cancel the order.

  1. Conclusion of the contract

The Site shows the essential characteristics and price of each Product.
Before sending an order through the Site, the Customer is required to carefully read all the instructions provided during the purchase procedure (also regarding delivery costs, the conditions for the exercise of the right of withdrawal and the Privacy Policy) as well as these General Conditions.
To make the purchase of the Products, the Customer must (i) place the selected Products in the “Shopping Cart” by clicking on the appropriate button, (ii) fill in the order, (iii) select the payment method, (iv) accept the General Conditions and (v) transmit the order to Art Casa srl through the Site.

Transmission of the order constitutes a proposal to purchase the selected Products, governed by these General Conditions and binding on the Customer. The transmission of the order by the Customer entails the latter’s obligation to pay the price of the Products ordered.

Once the order has been submitted, the Customer has the opportunity to make any corrections/changes to the data entered by contacting us by e-mail.
The Customer’s data related to the order will be kept by Art Casa srl for the period of time required by current regulations, as described in the Privacy Policy
Art Casa srl may, at its discretion, refuse an order within three days of receipt of the order. In such event, no amount will be due from the Customer to Art Casa srl.

Art Casa srl may refuse an order in case of unavailability of products, however, giving timely notice to the Customer. In this eventuality, the order is canceled, or accepted limited to the Products available. In case of partial acceptance, the Customer is required to pay only the price related to the available Products.

The Order Confirmation will contain a summary of the essential characteristics of the Products purchased, details of the price and method of payment, information on delivery charges, if any, and an indication of an e-mail address to which complaints may be submitted.
Following receipt of the Order Confirmation, the order may be cancelled or modified within 24 hours by e-mail communication. After this deadline, the order shall be deemed confirmed and irrevocable.
The risk of loss of or damage to the Products shall transfer to the Customer at the time the Customer (or a third party designated by the Customer and other than the carrier) takes physical possession of the Products.

  1. Methods of payment

The Customer may make payment of the consideration for the Products contained in the order and shipping charges, if any, by credit card, PayPal or wire transfer. As the purchaser, the Customer represents and warrants that it has lawfully obtained the funds used to pay the price of the Products (and related delivery charges, if any) and that it is not involved in any transaction intended to conceal the identity, origin or destination of the funds with which the Customer pays the price of the Products ordered (and related delivery charges, if any).
Transactions will be charged to the Customer’s credit card only after:
– the credit card details have been verified;
– authorization to charge has been received from the company issuing the credit card used by the Customer, and
– the availability of the Products has been confirmed by Art Casa s.r.l.

Payments can also be made by bank transfer to the following IBAN code: IT88C0306962772100000007907. All costs and expenses (including any fees associated with the bank transfer that may be charged, from time to time, to the Customer by its bank, shall remain the responsibility of the Customer. Payment must be made no later than 3 (three) business days from the date of Order Confirmation.

In the event that, for any reason, within the period provided for in the preceding article, it is not possible to charge the credit card with the amounts due by the Customer (or, in the case of a bank transfer, the funds corresponding to such amounts are not available on the bank account of Art Casa s.r.l.), it will not be possible to execute the contract and the order will be deemed cancelled.

For each order Art Casa s.r.l. will issue an invoice that will be sent to the Customer via e-mail. The invoice will be issued based on the information provided by the Customer at the time of the order. No changes to the invoice are allowed after it has been issued.

  1. Transportation and delivery

The Products purchased will be delivered by courier selected by Art Casa s.r.l. (hereinafter “Courier”) on business days. The Products will be delivered to the address indicated by the Customer in the order proposal. No deliveries are made to post office boxes.
Except in the case of force majeure events or unforeseeable circumstances, deliveries will be made within 7 to 10 working days from the date specified in the order.

Upon delivery. the Customer (or his delegate) shall check that the packaging and its seals are intact, undamaged, not wet or altered in any way. Any damage to the packaging and/or Products must be immediately disputed in writing on the Courier’s delivery note. Where permitted by applicable legislation, once the Courier’s document has been signed without the Customer having raised any objections, the Customer may not raise any objections about the external characteristics of the delivered package; it is understood that the Customer may also raise objections later, in accordance with the provisions of Article 13 below where such objections relate to the Products.

Art Casa s.r.l. to the Customer an e-mail confirmation of shipment after the shipment of the Products, also indicating the Tracking number and the indication of the courier.
