1. General rules

The following general terms and sales Conditions govern all sales of products concluded remotely on the website


2. Identification of the seller

Purchases made through the Website by customers are processed by Art Casa s.r.l., of which the brand Toniato Interiors is part, with registered office in Via Guido Rossa 7, 35020 Ponte San Nicolò (PD) Italia VAT n. 01338880287, Fiscal Code n. 01338880287, REA number PD – 205090.


3. Information about products and their availability

The information relating to the Products, with the Product codes and their price, are available on the Site.
Art Casa srl reserves the right to limit, at any time, the quantity and/or type of Products purchased on the Site. The style, models and colours of the Products described on the Site may be modified without notice. During the purchase process, if it is not possible to process the order due to the unavailability of the Product ordered, the Customer will be notified by e-mail.
Art Casa srl is in no case responsible for any errors arising from the failure to operate the connection of the Customer to the Site.


4. Price

The price of the Products indicated on the Site is expressed in Euro and doesn’t include all applicable taxes or duties. Any delivery costs must be added to the price of the Products.
rt Casa srl constantly verifies the accuracy of the prices indicated on the Site; however, it is not possible to guarantee the absence of errors. In the event that an error occurs in the indication of the price of a Product, Art Casa srl will reject the order and offer the Customer the opportunity to purchase the Product at the correct price. If the error is found only after the acceptance of the order, Art Casa srl will offer the Customer the possibility to cancel the order.


5. Conclusion of the contract

The Site contains the essential characteristics and the price of each Product.
Before placing an order through the Site, the Customer is required to carefully read all the instructions provided during the purchase process (including the delivery charges, the conditions for exercising the right of withdrawal and the Privacy Policy) as well as these General Conditions.
To purchase the Products, the Customer must (i) enter the selected Products in the “Cart” by clicking on the appropriate button, (ii) fill in the order, (iii) select the payment method, (iv) accept the General Conditions and (v) send the order to Art Casa srl through the Site.

The transmission of the order constitutes a purchase proposal relating to the selected Products, governed by these General Conditions and binding on the Customer, without prejudice to the right of withdrawal provided for in Article 8 below. The transmission of the order by the Customer entails the obligation of the latter to pay the price of the Products ordered.

Once the order has been sent, the Customer has the opportunity to make any corrections/ changes to the data entered by contacting us by e-mail.
The Customer’s data relating to the order will be kept by Art Casa srl for the period of time provided for by current legislation, as described in the Privacy Policy
Art Casa srl may, at its discretion, refuse an order within three days of receiving the same. In this case, no amount will be due by the Customer to Art Casa srl.

Art Casa srl may refuse an order in case of unavailability of the products, giving timely notice to the Customer. In this case, the order is cancelled, or accepted limited to the Products available. In the event of partial acceptance, the Customer is obliged to pay only the price relating to the Products available.

The Order Confirmation will contain a summary of the essential characteristics of the Products purchased, a detailed indication of the price and the methods of payment, information on delivery costs, if any and an addressemail to which you can submit complaints.
After receipt of the Order Confirmation, the order may be cancelled or modified within 24 hours by e-mail communication. After this deadline, the order will be deemed confirmed and irrevocable.
The risk of loss or damage to the Products is transferred to the Customer when the latter (or a third party designated by him and other than the carrier) materially takes possession of the Products.


6. Payment methods

The Customer may pay the fee for the Products contained in the order and the shipping costs, if provided, by credit card, PayPal or bank transfer. As purchaser, the Customer declares and warrants that it has legally obtained the funds used to pay the price of the Products (and the related delivery costs, if any) and that it is not involved in any transaction intended to hide identity, origin or destination of the funds with which the Customer pays the price of the Products ordered (and the related delivery costs, if any).
The Customer’s credit card will be debited only after:
– the credit card details have been verified;
– the credit card used by the Customer has been approved by the issuing company, and
– the availability of the Products by Art Casa s.r.l.

Payments can also be made by bank transfer to the following IBAN code: IT88C0306962772100000007907. All costs and expenses (including any fees associated with the bank transfer that may be charged, from time to time, to the Customer from his bank, remain at the expense of the Customer. Payment must be made no later than 3 (three) working days from the date of Order Confirmation.

In the event that, for any reason, it is not possible to charge the amounts due by the Customer to the credit card within the period provided for in the previous article (or, in case of bank transfer, the funds corresponding to these amounts are not available on the bank account of Art Casa s.r.l.), it will not be possible to execute the contract and the order will be considered cancelled.

For each order Art Casa s.r.l. will issue a special invoice that will be sent to the Customer by e-mail. The invoice will be issued on the basis of the information provided by the Customer. No changes are allowed to the invoice after its issuance.


7. Shipping and delivery

The Products purchased will be delivered by carrier selected by Art Casa s.r.l. (hereinafter “Carrier”) on working days. The Products will be delivered to the address indicated by the Customer in the order proposal. No deliveries are made to PO boxes.
Unless force majeure or unforeseeable circumstances occur, deliveries will be made within 7/10 working days from the date indicated in the order.

At the time of delivery, the Customer (or his delegate) must check that the packaging and its seals are intact, not damaged, not wet or altered in any way. Any damage to the packaging and/or the Products must be immediately contested in writing on the delivery note of the Courier. Where permitted by current legislation, once the Courier document has been signed without the Customer having raised any objections, the Customer may not object to the external characteristics of the package delivered; It is understood that the Customer may also raise disputes later, as provided for in Article 13 below if such disputes concern the Products.

Art Casa s.r.l. to the Customer an e-mail confirming the shipment after the shipment of the Products, also indicating the number of Tracking and the indication of the carrier.
